1. Introduction

Welcome to Wangsai Speedboat, operated by Wangsai Speed Boat Limited Partnership (“we,” “us,” “our,” or “the Company”). These Terms and Conditions (“Terms”) govern your use of our website, booking of tours, transfers, and participation in our services.

By accessing our website, making a booking, or participating in our tours, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

2. Definitions

• “Company,” “we,” “us,” “our” refers to Wangsai Speed Boat Limited Partnership and Wangsai Speedboat.
• “Customer,” “you,” “your” refers to the person making a booking or participating in our services.
• “Services” refers to all tours, activities, transportation, and related services provided by the Company.
• “Website” refers to the Wangsai Speedboat website and any related platforms.
• “Tour” refers to island hopping trips, private charters, or any other tour package offered by the Company.
• “Transfer” refers to ferry tickets, airport transfers, hotel transfers, or private boat taxi services offered by the Company.
• “Participant” refers to any person participating in a tour or transfer, whether or not they made the booking.

3. Booking and Reservations

3.1 How to Book

3.2 Booking Confirmation

• All bookings are subject to availability.
• Your booking is confirmed only when you receive a written confirmation email from us.
• Confirmation includes service date, time, pickup location, and booking reference number.
• Please check all details carefully and notify us immediately of any errors.

3.3 Minimum Age Requirements

• Participants must be at least 1 year old to join our speedboat tours.
• Children aged 2 and under are complimentary (must sit on adult’s lap during boat transport).
• Children aged 4-11 years are typically charged the children’s rate (rates may vary by package).
• Children 12 years and older pay the regular adult rate.
• Minors under 15 years old must be accompanied by a responsible adult.

3.4 Group Bookings

• Group discounts available for large parties.
• Private charter arrangements available upon request.
• Contact us directly for group rates and custom itineraries.

3.5 Accuracy of Information

You are responsible for providing accurate information including:

• Full names of all participants
• Contact details (phone, email, hotel address)
• Dietary requirements and allergies
• Medical conditions that may affect participation

Failure to provide accurate information may result in service disruption without refund.

4. Pricing and Payment

4.1 Prices

All prices are listed in Thai Baht (THB) unless otherwise stated. Prices include hotel transfers (where applicable), meals (if specified in itinerary), equipment, guide services, and insurance. Prices are subject to change without notice, but confirmed bookings will honor the quoted price.

4.2 Payment Methods

• Credit/Debit cards (Visa, MasterCard, American Express)
• Bank transfers
• Cash (for on-site bookings or as arranged)
• Online payment platforms as specified on our website

4.3 Payment Terms

• Full payment is required at the time of booking to confirm your reservation.
• Payment must be received before the service date.

4.4 Currency and Exchange Rates

All transactions are processed in Thai Baht (THB). If paying in foreign currency, exchange rates are determined by the payment processor or bank. Any currency conversion fees are the responsibility of the customer.

4.5 Receipts and Invoices

A receipt/invoice will be provided upon payment. For tax purposes, please request a tax invoice at the time of booking. All invoices are issued by Wangsai Speed Boat Limited Partnership.

5. Cancellation and Refund Policy

5.1 Cancellation by Customer

More than 24 hours before departure:

• 95% refund of the booking price.
• Refund processed within 7-14 business days to original payment method.

Less than 24 hours before departure:

• No refund.
• Booking is non-refundable and non-transferable.

No-Show:

• No refund for failure to appear at pickup location or pier.
• No refund for missed boats due to late arrival.

5.2 How to Cancel

To cancel your booking:

• Cancellation is effective when you receive written confirmation from us.

5.3 Refund Processing

• Refunds are processed to the original payment method.
• Processing time: 7-14 business days from cancellation confirmation.
• Bank processing times may vary; we are not responsible for delays by financial institutions.

5.4 Rescheduling

• Dates may be rescheduled subject to availability.
• Rescheduling must be requested at least 24 hours before the original service date.
• Rescheduling is subject to price differences if applicable.

5.5 Cancellation by the Company

Weather-Related Cancellations: Speedboat travel is strictly subject to weather and sea conditions. If conditions make the trip unsafe, we reserve the right to cancel or modify the itinerary. You will be offered a full refund or a reschedule to another date at no additional charge.

Operational Reasons: Tours may be cancelled due to insufficient bookings (for join-in tours). Notification provided at least 24 hours in advance with a full refund or alternative date offered.

6. Participant Requirements and Health

6.1 Health and Fitness

• Be in reasonable physical health.
• Be able to board and disembark speedboats, sometimes in shallow water/beach landings.
• Be capable of enduring speedboat impact on waves.
• Disclose any medical conditions that may affect participation.

6.2 Medical Conditions

Warning: Speedboat travel can be bumpy. It is strictly not suitable for:

• Pregnant women
• Individuals with severe back, neck, or spine problems
• Individuals with serious heart conditions
• Individuals with severe mobility limitations

6.3 Disclosure Requirement

You must inform us at the time of booking of any medical conditions. Failure to disclose relevant medical information may result in denial of participation without refund and assumption of full liability for any resulting injury.

6.4 Alcohol and Substances

Participants under the influence of alcohol or drugs will not be permitted to board the vessel. No refund will be provided if you are denied participation for this reason.

7. Safety and Conduct

7.1 Safety Guidelines

• Attend the mandatory safety briefing given by the guide/captain.
• Wear life jackets at all times while the boat is in motion and while snorkeling.
• Follow all instructions from guides and crew.
• Do not sit on the bow (front) of the speedboat while it is moving.

7.2 Guide Authority

Captains and Guides have full authority over safety decisions. They may modify itineraries based on tides, weather, or safety. Failure to comply with instructions may result in removal from the tour without refund.

7.3 Environmental Responsibility

• Use only reef-safe sunscreen.
• Do not stand on coral reefs.
• Do not feed marine life or monkeys.
• Take all trash back with you (“leave no trace”).

8. Liability and Insurance

8.1 Assumption of Risk

By participating, you acknowledge that marine activities involve inherent risks (sea conditions, marine life, sun exposure) and you voluntarily assume these risks.

8.2 Limitation of Liability

To the maximum extent permitted by law, the Company is not liable for indirect, incidental, or consequential damages. The Company’s total liability is limited to the amount paid for your booking.

8.3 Personal Property

You are responsible for your personal belongings. Speedboats can be wet; please use waterproof bags. The Company is not responsible for electronics or valuables damaged by water or lost at sea.

8.4 Insurance

Our tours include basic accident insurance as required by Thai Law. However, we strongly recommend purchasing your own comprehensive travel insurance covering medical evacuation and trip cancellation.

9. Photography and Media

9.1 Photography During Tours

By participating, you consent to being photographed or filmed during the tour for promotional purposes. If you prefer not to be photographed, please inform the guide before departure.

9.2 Drones

Drones are generally not permitted in National Park areas without prior official written authorization from park rangers. Unauthorized use may result in fines.

10. Transportation and Pickup

10.1 Hotel Pickup Service

Complimentary hotel pickup is included for designated zones in Ao Nang. Remote locations (e.g., Klong Muang, Tubkaek, Krabi Town) may incur a surcharge or require meeting at a designated point.

10.2 Pickup Times

Exact pickup time will be confirmed via email/message. You must be ready in your hotel lobby 10-15 minutes before the scheduled time.

10.3 Late or Missed Pickup

Drivers operate on a strict schedule. If you are not ready, the vehicle may depart without you to avoid delaying other guests. No refund is provided for missed tours due to lateness.

11. Itinerary and Services

11.1 Itinerary

The tour itinerary is a guide and may vary due to tides, weather, and sea conditions. The captain determines the safest route and order of islands on the day of the trip.

11.2 National Parks

Many of our destinations (e.g., Phi Phi, Hong Islands, 4 Islands) are within National Parks. National Park fees are mandatory and are usually collected in cash on the day of the tour unless stated as "included" in your specific booking package.

11.3 Inclusions

As stated in your specific booking confirmation, typical inclusions are:

• Hotel transfers (designated zones)
• Drinking water and seasonal fruit
• Lunch (for full-day tours)
• Mask and snorkel usage
• Life jacket
• Guide and Insurance

12. Food and Dietary Requirements

12.1 Meals

Lunch on full-day tours is typically a Thai buffet served on the beach or at a restaurant. Halal and Vegetarian options are generally available.

12.2 Dietary Requirements

You must inform us of specific allergies or dietary requirements at the time of booking. While we try to accommodate requests, options on remote islands may be limited.

14. Website Use and Disclaimers

• 14.2 Third-Party Links: We are not responsible for the content of linked third-party websites.

15. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy which explains how we collect, use, and protect your personal information.

16. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, extreme weather, government actions, or failure of suppliers.

17. Complaints and Dispute Resolution

Notify your guide immediately during the tour so we can address issues in real-time. For post-tour complaints, contact us within 7 days via email. Disputes are subject to Thai law.

18. General Provisions

These Terms constitute the entire agreement between you and the Company. We reserve the right to modify these Terms at any time.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the Kingdom of Thailand. Any legal action shall be brought exclusively in the courts of Krabi, Thailand.
